Flach Marsh, Kent: Exemplification of order concerning surrender of land

Exemplification, at the request of Thomas Carter, gentleman, of a record on the Memoranda Roll of Trinity 39 Elizabeth (1597). The College, by Sir Thomas Egerton, attorney general, brought a bill, stating that one Simon Grenestreete, of Ospringe, co. Kent, yeoman, on 30 September 1586 claimed title to the Flache and entered the same. Grenesteete appeared and answered that one Martyn James, late of Smarden, co. Kent, esquire, being seized of a messuage with certain lands in Luddenham, Oare and Faversham, commonly called Upper Howletts and Nether Howletts, and 12 acres of upland, by an indenture of 14 August 1591 let the premises to him the defendant from Michaelmas next for 7 years. He denied having entered the Flache, and denied that any of the premises demised to him were part of the Flache or had ever been so called. He cited Henry James, esquire, son and heir of the said Martyn James, who held the reversion of the premises, to support his statement, who at Michaelmas 1594 (36 Elizabeth) appeared and answered in confirmation of Grenestrete’s answer. Accordingly it was ordered in Hilary 1595 (37 Elizabeth), that as there was no dispute as to the title of the Flache but as to the boundaries thereof were somewhat uncertain, a commission should be appointed to perambulate and plot the land. Which was done, and it was found that 83 acres of pasture and marsh land in Luddenham, called the Flache, which belonged to the College, were in the occupation of the defendant. It was therefore decreed that the defendant should surrender the same to the College upon pain of £1000.
