Goldcliff and Coldrey, Monmouthshire: Writ of execution
Item
25 June 1635
Writ of execution, directed to Edward Morgan, esquire. By a bill in chancery of 18 February 1634 the Provost and College complained that the defendant, Morgan, illegally refused to pay 30 oxen in kind yearly. By an agreement of 20 June 1583 the College had consented to receive all the rent from the manor of Goldcliff in money. But Provost Savile had found the lack of beef for the maintenance of the College to its prejudice and had declared that the said agreement was void in law as it had been made after the Act 18 Elizabeth for the better maintenance of learning and relief of scholars of the universities of Cambridge and Oxford and in the colleges of Winchester and Eton. He had refused to accept the rent in money and had demanded it in kind, and the then Edward Morgan had consented to pay the same as had William Morgan, his son, father of Edward Morgan, the defendant. At St James' tide before the exhibiting of the bill the defendant had refused to continue such payment, being encouraged in his refusal by having in his possession the counterpart of the orginial lease to William Morgan his great-grandfather and a bond of £1000 for the performance of covenants, and that part of an indenture of 20 May 1569 and a bond of £500 which should have remained with the College. The bill and defendant's plea, demurrer and answer are recited and the decree of 15 June 1635 by which the defendant is ordered to pay the 30 oxen.
