Beckford, Gloucestershire and Colsterworth, Lincolnshire: Indenture of agreement concerning pasture

Indenture of agreement between Thomas son of Thomas of Eston [Easton in Stoke Rochford] and the Prior of Bekeford who had brought a plea against him before the Justices of the King's bench at Westminster concerning 224 sheep of the said Prior seized by the said Thomas in the town of Colsterworth in a certain place called Rishinge by the water of Wyme [Witham] in which place the Prior claims for himself and his men of Colsterworth to have common for one whole year for all his beasts and each other year after the cutting and leading of the hay until the Purification, which right he and his predecessors have had time out of mind. The plea is settled as follows, that the said Thomas agrees that the Prior shall have common as aforesaid with free and sufficient ingress and egress, and Thomas is to hold Rishinge in severalty until the time that the neighbours cut and lead their meadows but is not out of malice to allow the hay growing there to be cut or led during the time of the said severalty in which the Prior and his men are not able to have their common as by right they ought to have, but if he does so he grants that the Prior may use and enjoy his common whether the grass is standing or the hay lying. The part of the indenture remaining with the Prior is signo dicit Thome signatum, that with Thomas sigillo dicit prioris roboratum.
