Cottisford, Oxfordshire: Indenture of lease of warren

Indenture of lease, by Edward Holte, of Duddeston, co. Warwick, esquire, to Thomas Ferryplace, of Cotisfoorde and of Hylsdon, co. Bucks, gentleman, of a warren of conies and warren ground in the manor or lordship of Heyth [Heath], co. Oxford, and certain pieces or flats of land adjoining Cotisfoorde fields [Cottisford] within the parish of Heyth and parcel of the manor of Heyth, containing eighteen score acres or thereabouts; reserving always to the tenants and inhabitants of Heyth liberty to "hunte and hey" at all times within the circuit of their corn fields in Heyth on the nearer side of the brook or river to them but no further, and to kill the conies therein for the better safeguard of their corn. From Lady day next for 15 years, and after that term to the 20 February then next following. Rent £20 a year, and a further £20 between the expiry of 15 years and the 20 February following. The lessee is to restore the warren as he found it, neither having dug up or defaced "the boroughes and conie berries of the said warren" nor having multiplied the conies to the excessive damage of the corn fields; and at the reasonable request of the tenants of Heyth he is to do this best to take and kill such conies as shall breed beyond Gallowse Slade or elsewhere near the borders of the corn fields. The premises had been leased by Humphrey Ferrers, esquire, to Richard Norres, of Birmingham, upon whose failure to pay his rent Edward Holte, as lawful assignee by demise of the said Ferrers, had entered and put out the said Norres.
