Gregory Ainscombe, Inner Temple, to Sir Henrye Savile, Knight, Provost of Eton. The inhabitants of Warninge Campe, at the instigation of Mr Herne, have caused him to be cited to the spiritual court at Chichester to shew cause why the profits of Warninge Campe should not be esquestered for want of officing the chapel there. He has alleged to the court that a similary suit before the High Commissioners was recently dismissed upon evidence shewn by the College, which evidence he offered to produce to the court in a convenient time. The urged him in the meanwhile to be at the charge of officing the same, promising that, if hereafter it did appear to the court that the same burden did not justly lie upon him but upon some other, he should be paid all his charges by that party. Whereupon he promised to do so for a time and to deduct the same charges out of the vicar of Leominster's pension. The court then prejudicially said unto him that unless he showed a compostion which expressly set down that the pension granted to the vicar of Leominster was for the officing the same chapel, he (Ainscombe) would be still charged therewith.
He asked Savile's advice what to do. He himself thinks it best to have a prohibition and try and case at common law. Could Savile come to London to consult with counsel? Failing that, will be send his opinion on what should be done for discharging the College and himself from so unjust a burden. And will he cause the records to be searched for the aforesaid composition.
