Indenture of memorandum that between the Abbess and nuns of Almonach, rectors of the church of Clymping, plaintiffs, of one part and Sir John de Vyenna, rector of the church or chapel of Codelawe, defendant, of the other, a question of spoliation arose concerning the tythes issuing from 18 virgates of land (a virgate reckoned of 16 acres) in Codelawe, and a provocation and appeal was made by the nuns to the Apostolic See and for protection to the court of Canterbury against the said spoliation. On the intervention of friends, an agreement was made between the lady Agatha, prioress of Lunemenstr', proctor for the Abbess, and the said rector, (on seeing the appropriation of the church of Clymping to the nuns and other tenants) by which the latter on a day fixed would appear in the court of Canterbury and renounce the provocation and appeal from that court to the Holy See, and recognise the tythes as belonging to the nuns, and restore those he had withdrawn, and would have the writ of the lady Mary, his patroness, revoked by her sealed letters patent; and the nuns would recognise the rector's possesssion in the tythes of other lands which he and his predecessors had hitherto received in the name of the church or chapel of Codelawe. The parties named their sureties, viz. for the Prioress, master William de Hiburgheden and Richard de Heghes and for the Rector, master Thomas de Codelawe, Rector of the church of Cherlewode.
