(1) Trinity term 1638. In the Exchequer. To William (Juxon), Bishop of London, Lord Treasurer, Francis, Lord Cottington, Chancellor and Under-Treasurer of the Exchequer, Sir Humphrey Davenport, Knight, Chief Baron, and the other Barons of the court.
Bill of complaint of Anthony Topham, DD, Dean of Lincoln, Hamblett Marchall, DD, Chanter and one of the Chapter there, Robert Meeres, DD, Chancellor, Morgan Wynne, DD, Archdeacon, Robert Nevell, DD, Subdeacon, and the rest of the Chapter there, debtors and accountants to the Crown, showing that they are entitled to a pension of 26s 8d from the Rectory of Oakley, of which the College of Eton is seized in fee and Robert Faldowe is the occupier and farmer, and complaining that some persons have made and contrived secret estates and conveyances by which the plaintiffs cannot make it appear from what lands the said pension should issue and so cannot recover the same at common law, and therefore they ask for the issue of a writ of distringes against the College of Eton and writs of subpoena to Robert Faldowe and others to appear before the Court of Exchequer Chamber to answer concerning the premises.
(2) The joint and several Answer of Thomas Wever and John Harison, two of the Fellows on behalf of themselves and of the College, defendants, to the Bill of complaint of Anthony Topham, Dean of Lincoln, Hamlett Marshall, Chanter of the Cathedral of Lincoln, Robert Meers, Chancellor, Morgan Wynne, Archdeacon, Robert Nevell, Subdean, and the rest of the Chapter there, complainants. By Patent of 30th August 1547 King Edward VI granted the College the Rectory of Okley to hold in perpetuity by the service of the fortieth part of a Knight's fee for a rent of 23s 8d and 3s 4d to be paid to the Bishop of Lincoln, and 14s 2d to be paid out of the Rectories of Bromham and Oakley for synodals and procurations. No sum of 26s 8d was ever due to the church of Lincoln from the Rectory of Oakley, nor has the College made any conveyance of the premises now in being save one lease not exceeding 21 years to John Faldoe.
