Royal Patents: Exemplification concerning rent
Item
6 November 1519
Exemplification of a plea in the Common Pleas before Robert Rede and his fellow justices, enrolled on the Plea Roll of Hilary 4 Henry VIII [1515]:
Norf. Roger Lupton, Provost, and the College of Eton v. William, prior of Horsham St Faith's, for a debt of 8 marks claimed from the latter for a yearly rent of 2 marks. The said rent used to be paid to the abbot of Conches until 10 Edward III when, on account of the war with France, the rent was seized into the hands of the crown which continued to receive the same until on 14 July 1439 Henry VI granted it to Humphrey, duke of Gloucester, for his life, and on 25 January 1442 granted the reversion thereof to Henry Sever, Provost of Eton, and the College. Since the duke's death the College has received the rent until on 13 November 1511 the prior refused to pay it. The loss amounts to 20 marks.
The prior says that the abbot of Conches was not seised of the rent by right of the said abbey. The parties place themselves upon the country. Arrears and damages awarded to the Provost of £10 13s 4d. Teste J. Ernele, chief justice of the common pleas. Given at Westminster.
Seal of the Common Pleas, bronze wax, on doubled tag. The initial H not filled in.
